We joined Treoc as Platinum Members in 2007. At that stage we already owned 5 properties which we were then advised to transfer to the newly created Investment Trust using the usufruct method.

In September 2009 we received notification that SARS was conducting an audit on my husband’s personal tax returns and the investigating officer specifically requested information relating to the transfer of the properties. It was explained to her that the transfers were done using the usufruct method, but she insisted that either capital gains tax, transfer duties or donations tax was payable. Needless to say this caused a great deal of stress and angst in our home.

I contacted Theo Naude at the Pretoria office regarding this matter, and he referred me to Hanlie de Boer in Randburg. Hanlie was very knowledgeable and even offered to speak to the SARS investigating officer personally so that she could explain to her how usufruct transfers works. This was a great boost to our morale, as the SARS investigating officer was becoming rather insistent that we owed a great deal of money.

After providing SARS with all the documents that they requested (proof of registration date, property values, transfer duties paid, title deeds, etc.), the investigating officer still felt that there were duties payable.

Theo and Hanlie communicated directly with SARS, providing them with all the documentation they required. In addition they both attended a meeting in Pretoria which was attended by the SARS investigating officer, her supervisor and the SARS Legal representative. During this meeting Hanlie and Theo explained the TREOC method to them as well as clarified that all required duties were paid correctly, in accordance with the usufruct transfer method, and that no additional duties were payable. Following this meeting, SARS was satisfied with the explanations, resulting in the completion of audit with no extra payments requested from us, with respect to the usufruct transfers.

Following the meeting with SARS, Theo and Hanlie spent an additional two hours with us, providing feedback on the meeting that they had with SARS.

Hanlie also went further, beyond the “call of duty”, to assist us with our personal tax as far as the usufruct transfers of the five properties were concerned and the tax calculation that has to be applied for these types of sales. Without her expertise it would have been very difficult, if not impossible, for us to complete our tax returns on time, and correctly. Subsequent to filing our returns, the SARS assessment shows no payment due for these transfers, which bears testimony to the accuracy of the information provided to me by Hanlie.

In must also applaud Theo for his perseverance, dedication and assistance in this matter. On more that one occasion he was still in the office after 9 pm sorting out documents for SARS and working on the financial statements that were requested by SARS. Without his perseverance and communication with SARS, this matter could have turned out very different for us.

My sincere thanks to Hanlie for helping us out in this very stressful time. Although we are not her clients, she never hesitated to accept calls from us and was always forthcoming with the right information about taxation, both for the trust and in our personal capacity. Hanlie is an invaluable member of TREOC and I would strongly recommend that she is part of the TREOC “roadshow” to explain the tax implications of usufruct transfers to investors.

May I in conclusion state that the monthly fee we pay to TREOC Accounting has been worth every cent, as we have received dedicated assistance and expert advice which would have cost a lot more if we needed the services of an outside accountant.

I just wanted to say a big thank you to you for making your PPMs available to us, the members. My husband, Stuart, and I have been helped by TIna in Cape Town, and I have to say she has literally changed my life.

This email is a short word of saying thanks u for the wisdom that you share with us weekly. Your gift from God equip/motivate/inspire I and other people on a weekly basis and I thank you for serving your leadership/gift to us!!

The week following your Treoc Times Ref 188 newsletter a similar situation occurred in Worcester, but with a different outcome I believe. My brother is dating a young lady who’s dad (a pastor in the local church) past away on the Saturday night after a long cancer sickness. When I spoke to her on the Sunday I mentioned to her the story of the lady you met at the braai and the ridiculous estate laws.

What was shocking to me is that she and her dad had time to plan but they were under the impression that giving her ‘signing rights’ on his bank account will sort out the challenge incase of his death. When I explained to her that they will freeze the bank account when they heard the news of his death, and that this will have a cash flow challenge on her life (since she did not work but looked after her sick farther for the last couple of months) she was shocked.

I thought afterwards why people (and I until I read your email) could find ourselves in such challenging situations, which can be avoided? Why did someone in the pastors congregation not given him more insight? Why did he not know if this since he is much closer to death (and life) than most other people? Surely he must have had accountants, bank executors, etc in his congregation?

Is this lack of knowledge not maybe the same reason why 4-6% of private companies fail in the first 10 years, why people do not buy property in double trusts, etc? Is this because their parents did not know it and hence they could not transfer the knowledge? Etc.

One of the solutions is your emails which I forward onto people all over the world. The other one might be light-minded which I read with a smile and enjoy. And I believe the next one will be Treoc TAN!
