People are always looking for the best returns or interest on their investments. They are also always scared that they are not investing in enough different instruments. At the end of the day they have a widely diversified portfolio, with a bit of money in each area – and so the portfolio shows the same kind of growth as the rest of the market: average. The only way you can achieve outstanding results is by specialising.<br />
The master of specialisation, Warren Buffett, said the following:</p>
<p><em>“Wide diversification is only required when investors do not understand what they are doing.”</em></p>
<p>I have a very simple calculation that I share with people at my workshops, and each time I am astounded at the impact that it has on the delegates. I think it is the simplicity of the calculation that bowls people over. No-one can argue with it. Not even the most aggressive financial planner!</p>
<p><strong>Let me share the calculation and assumptions with you:</strong></p>
<p>Two years ago someone bought a townhouse on the East Rand with a R600,000 bond, and they are currently letting it out. The value of the bond on the house was R600,000 at the beginning of 2011, and during 2011 the bank valuation grew by 6.2%. (See the ABSA link at the bottom to confirm the growth if you want to.) The monthly shortfall after the bond payment and costs on the house is R2,500 per month. This payment of R2,500, or R30,000 per year, will decrease every year if we increase the rental by the rate of inflation each year. So the question now is whether the R30,000 shortfall in 2011 was a waste of money. I say no – it’s a method of forced saving, and it gives an unusually high return. Let’s look at the calculation:</p>
<p><strong>Simple calculation on East Rand house</strong></p>
<p>R600,000 – House value – This is the value on which the 6.2% East Rand growth is calculated.<br />
R30,000 – Shortfall – This is the amount that is “invested” every year.<br />
R37,200 – Growth on house value – This is the return on the investment.<br />
124% &#8211; Gross Return – 37,200&#215;100/30,000</p>
<p>So if you’d “saved” R30,000 last year by using it to cover the shortfall on a townhouse on the East Rand, you would have received 124% “interest” on it. Show me anything that can beat that!</p>
<p>Every time I publish figures like this, there’ll be some of the money powers’ highly trained advisors who take me to task over it. They want you to rather invest your money in their useless savings plans, endowment policies and pension schemes, of course. So they make as if they don’t understand my simple calculation, and they slate it as incomplete, faulty and ridiculous. They want ordinary people to think that it’s complicated to make money, and that only they have the wisdom and knowledge to help you with it. That’s nonsense. You can do it yourself, and you can do it better.</p>

<p><strong>Ai&#8230; Ai&#8230; Aikona!</strong></p>
<p>I hope you don&#8217;t mind me mailing the following story to you, but this came across my desk this morning and I think this is a matter of national interest. I have no idea who the author is, but it is good enough to be shared. Here goes:</p>
<p><em>&#8220;I think, and I am sure that many of you are the same, that the tolls are a disgrace, both the extortionate toll fees themselves and also the widely published fact that we are expected to pay up to R18 BILLION over the next 10 years just to collect the toll fees.  I wanted to share the clarity of thought in this mail and agree that I will not be installing anything on my car.   </p>
<p>They are not going to have easy access to my bank account &#8211; they say they want a debit order &#8211; forget it.  Send me a bill (by registered mail) every time. </p>
<p>Together we can make this whole thing fail &#8211; as it should.  Let the toll gates stay there, not working, as monuments to people power. Let&#8217;s call this the start of the SA Awakening, look what the normal people are achieving in North Africa with the Arab Awakening.  </p>
<p>I hope this goes around at least a billion times.</p>
<p><strong>Taxes and Open Road Toll Fees</strong></p>
<p>People should not install the transponders but still use the highways and force the government to issue accounts and summonses to all motorists until such time they drop the prices. The government will be forced to send out millions of accounts every month and they don&#8217;t have the manpower to do it. This is the best and easiest way to boycott the system.</p>
<p>What is the government going to do about motorists from other neighboring countries that don&#8217;t have these transponders? South Africans are too complacent and its time we fight back.  </p>
<p>WE have paid for these roads. Now they are also proposing a 1% tax to fund the SABC.</p>
<p>Circulate this to all your friends!!!!!!!! </p>
<p>Has anyone thought just how much tax we are already paying?</p>
<p>            a. 35% on your salary</p>
<p>            b. 14% on everything you buy (bar fresh produce) and services rendered.</p>
<p>            c. Carbon tax if you buy a new car (besides the 14% VAT you have to pay)</p>
<p>            d. Tax on the fuel you put in your car to run it.</p>
<p>            e. Toll on our roads &#8211; </p>
<p>For some it is going to come to a whopper of 10% of your salary (If you earn R10 000.00 a R1 000 would go toward tolling if you migrate between PTA and JHB every day.) &#8211; Bully to try and pacify me with the idea that I can claim it back from my income tax!!! I have to fork out the money first. Going on holiday to DBN? Remember to save up your R1000.00 for tolling.</p>

<p>If you can get unlimited bonds and you take them all, do you think you won’t have to pay for them? I think most of you are now wondering whether I’m stupid for asking you something like this, because everyone knows that bonds cost money!</p>
<p>Well, not everyone is that smart. After I wrote on Facebook that people can get unlimited bonds with the ALA method, there were actually people who accused me of “reckless lending”. Can you believe that in this modern age there are still people who can’t manage their own financial affairs? Incredible! No wonder the Money Powers are just growing wealthier and wealthier with the licensed fraud they are peddling.</p>
<p>This is what I wrote on Facebook and what led to the accusation of me committing reckless lending:</p>
<p><em>“Whoa! It was a great crowd at the Hilton workshop yesterday! Welcome to all the new members! Now you know how to get unlimited ALA bonds. I wish you millions! Thanks for attending.”<br />

<strong>What is the difference between Reckless Lending and Reckless Borrowing?</strong></p>
<p>There is a big difference between these two. Reckless Lending is when you clearly cannot afford something, but a credit organisation like a bank still gives you a loan. The Consumer Protection Act was specially created to protect people who can’t calculate and manage their own financial affairs.</p>
<p>Reckless Borrowing is something else entirely, though, and there is no law that will protect you from yourself. This is when people lie about their income or expenses, for example, in order to get more bonds than they can afford or qualify for. It is stupid, very stupid!</p>
<p><strong>What do we do with unlimited bonds like the ALA bonds?</strong></p>
<p>We take as many as we can afford. With ALA you have minimal attorneys’ costs, and perhaps agent’s commission, but other than that you are actually only paying the monthly shortfall on the property. In November I bought a property with the ALA method, and the total monthly shortfall excluding any voluntary provisions was just R73 per month. I didn’t need to apply for the bond and nor did I need the bank’s permission. I would have been very stupid not to have taken over this person’s bond, don’t you think? <p><em><strong>Top 11 Property Categories for 2011 </strong><br />
With the New Year upon us, we decided to take a moment to reflect on the year that was and compile a list of the<br />
Top 11 Property Categories for 2011.  Our objective being to determine best performers in terms of annual growth in average value for 11 different property categories.  And the winners are …   </p>
<p><strong>1 &#8211; Top Province</strong><br />
Our monthly House Price Indices consistently reported Eastern Cape as the leading province in 2011 and our recent survey confirms this.  Eastern Cape property appreciated by 9% over the year period, increasing from an average of R550 000 to R600 000. </p>
<p><strong>2 &#8211; Top Municipality</strong><br />
The historic Karoo municipality of Prince Albert steamed to first place for top municipality, with a 237% year on year annual growth in average property price.  Values escalated from R175 000 in 2010 to R590 000 for the same period in 2011.  Whilst it is not obviously evident which particular areas or drivers contributed to this substantial growth, this is typically seen where residential developments transfer to second buyers after building has taken place.  </p>
<p><strong>3 &#8211; Top Inland Town </strong><br />
The peaceful West Coast gem of Vredenburg claimed the title top inland town with a rise in average value from R324 000 in 2010 to R560 000 in 2011, effectively 73% year on year appreciation. It is believed that – once again – residential developments backed by growing commercial appeal – is the strongest catalyst of this growth. </p>
<p><strong>4 &#8211; Top Coastal Town </strong><br />
Kenton-on-Sea, a seaside retreat on the Sunshine Coast in the Eastern Cape, saw the average property value increase by 50% from 2010’s R1 million to R1.5 million in 2011.  Kenton-on-Sea boasts many pristine beaches and its popularity as an eco-tourist’s paradise (its permanent population of about 1000 balloons to nearly triple that over the December holiday period) is more than likely a strong factor in progressive property value growth in the area.</p>
<p><strong>5 &#8211; Top Residential Suburb</strong><br />
The Johannesburg North suburb of Broadacres came out trumps as the top residential suburb with a jump in average value from R930 000 in 2010 to R1 790 000 in 2011, a 92 % increase.   This appreciation can be mainly contributed to the extensive development in the area recently and more than likely driven by previously vacant stands being developed and sold.  </p>
<p><strong>6 &#8211; Top Luxury Investment Suburb </strong><br />
The prestigious De Zalze Golf Estate in Stellenbosch, Western Cape owns this crown with an average 7 year yield of 242%. I bought my first house in 1983 using the ALA (Alienation of Land Act 68 of 1981) method. Apart from some attorneys’ fees and my monthly bond repayment it didn’t cost me a single cent. No deposit or immediate transfer duty. Best of all, of course, was that I didn’t have to get the permission of any bank. Since 1983 I’ve bought many houses in the same way. Under www.treocinvestor.com‘s “Shared Investor” section, you can see an actual portfolio, Treoc 104, that consists of 21 of these ALA properties.</p>
<p><strong>Conventional bonds vs ALA<br />
</strong><br />
Buying property with the bank’s money is very hard these days if you want to do it in the conventional way, because getting bonds is still very difficult. According to one senior bank director that I spoke to recently, it’s going to get even more difficult in the future.</p>
<p>This means that the ALA method is going to be the only method for getting access to financing, and the number of enquiries I’m receiving about it at the moment tells me that our members also realise this.</p>
<p>The popularity of the method lies, of course, in the fact that you get access to 100% financing without having to apply for it and without having to qualify for it. Even someone who is blacklisted can get access to 100% financing with this method. I’m receiving plenty of emails from people who want to know how it works, how the purchase contract should look, who the attorneys are that we use for this, and so on. <p>Last week I told you how <a href=" http://www.lightminded.com/2011/12/29/victory/ "> <span style="color: blue"><strong> Pinky Sempe  </strong></span></a> got all her assets back after the court examined her trust and ordered the “vultures” to give the assets back without even requiring a court case! How was this possible? The courts are full of trust cases where it’s found that the trusts are not even worth the paper they’re written on. Of course, these are trusts that have been set up by amateurs. By amateurs I mean bookkeepers, auditors and attorneys who don’t actually specialise in trusts, but do it as a “favour” for their clients. </p>
<p>William Wordsworth said: “In modern business it is not the crook who is to be feared most, it is the honest man who doesn&#8217;t know what he is doing.”</p>
<p>At Treoc we’ve had to distance ourselves from supposed trust specialists in the past, because we’ve realised they are a danger to our members’ trusts. The infamous Surf Trust is one such example. The lessons we learnt from that horrible experience taught us how NOT to do things. We learnt how to do things correctly, and that is one of the reasons why <a href=" http://www.lightminded.com/2011/12/29/victory/ "> <span style="color: blue"><strong> Pinky Sempe</strong></span></a> got her assets back immediately. </p>
<p><strong>Why do people use amateurs?</strong></p>
<p>People think that a trust is a trust, and that’s the answer. Finish en klaar! They think it doesn’t matter who sets it up and manages it. Others think that it is the number of trusts that is important. Others again think that it is the type of asset that’s the secret. The smart guys realise that all of this is important, but that the correct administration of the trust structure is most important of all. <p>When it comes to the value of movable assets, a lot of people are relatively apathetic. Nowadays attention is only given to big matters and big things. You even see it in the game reserve, where people will drive over a rare dung beetle to get a better view of a buffalo. Why? Because the dung beetle isn’t one of the Big Five!</p>
<p>Some people have the same attitude with possessions as well. They are only concerned with the high-value properties, paintings, gold bars, and so on. The crockery, furniture and appliances are not considered important. This fact is regularly confirmed to me when I bump into Treocians.</p>
<p>Last month Vanessa and I were eating in a restaurant in Oudtshoorn one night when someone came up to us and introduced himself as a Treocian. He had attended my seminar in 2007. As people usually do, he told me about the properties that he had bought since then, and as I usually do as well, I asked him whether he had his trust structures in place. He answered in the affirmative and told me how happy he was with Treasury Trust’s services. I asked him whether he had already transferred his household contents to his asset trust. He then said that Treasury also asks him this regularly, but as he had told them, he hadn’t yet had time for this. I then also asked him whether he had at least insured his household contents. “Nah,’ he said, “it’s just a bunch of old stuff!”</p>
<p>It really worries me when people have an attitude like this. Do you have any idea how inconvenient it is to be without this “bunch of old stuff”? Do you have any idea how much it will cost to replace this “bunch of old stuff” if it gets repossessed, burnt up or stolen? If you don’t take precautions, you will one day suffer massive losses. Believe me; I’ve seen people lose everything time and again. And emotionally it’s far worse to lose a “bunch of old stuff” than, for example, a house that you’re renting out, because the “bunch of old stuff” doesn’t just have an unexpectedly high monetary value; it also has enormous sentimental value. Losing that dining-room suite that you got as a wedding present twenty years ago is not nice. Having to now go and buy another one at a high price with your hard-earned savings is not going to make you feel any better either.</p>
<p><strong>Make sure your double protection is in place</strong></p>
<p>Firstly, make sure today still that this “bunch of old stuff” all belongs to your family trust. If you don’t have a trust yet, set one up immediately. <a href=" http://www.treocserviceproviders.com/ "> <span style="color: blue"><strong> Treasury Trust  </strong></span></a> will help you.</p>

<p>In December 2011 Treoc entered into a new partnership with the well-known law firm DVB Legal and Financial Services (Pty) Ltd in Alberton. The new partnership will be known as LegalFin, and they will provide legal services like contracts and conveyancing to our members. In particular, this Treoc partner specialises in ALA transactions and usufruct registrations, through which they help Treocians transfer their properties into their trusts in the most cost-effective way. <p>In March 2007, I was contacted by a member of the committee that was encouraging all the plot owners to sell their properties to the bank and developer. During the initial several contact sessions I refused but later agreed to sell so that the planned township establishment project for affordable housing can be developed in Estoire.</p>

			<content:encoded><![CDATA[<p>Ever since the beginning of man&#8217;s existence he has sought ways to make his life easier. I’m sure that the first quests were for easy ways to get food and make clothing. Equally important, if not perhaps the most important, was his search for some kind of shelter, such as a cave or a house – somewhere that he could feel safe, and where he could protect his family against the elements of nature and dangers such as predator attacks or even attacks by other people.</p>
<p>Very soon there was probably a cave shortage, causing the value of caves to shoot up astronomically. People were prepared to pay for a good cave, but the people with caves couldn’t get rid of their caves until they had found alternative housing. So they started building structures like huts and houses for themselves and began renting out the caves. The &#8220;rental&#8221; was probably something like food and clothing. They saw that providing housing made their lives a whole lot more comfortable, and they started to wonder whether people wouldn&#8217;t perhaps be interested in the kind of huts they were building. A &#8220;letting agent&#8221; was appointed and he came back with the good news that there was great interest. The houses of those who could build well were most in demand, and never again did they have to find their own food or make their own clothes.</p>
<p>Some people, like old Coert from the Treoc region, couldn’t build good houses, but at the same time, they weren’t prepared to keep bringing food and clothing for the builders. So they bought the builders’ houses and made an agreement with them to provide food and clothing for them for 20 years, on condition that in the meantime they could do whatever they wanted with the house and that at the end of 20 years the house would become their property.</p>
<p>And so the property investors were born. Property investors weren’t necessarily good builders, but they were clever, very clever, because what they did was to rent the houses to a third party for more food and clothing than they had to pay to the builder. All that the investors actually did was to organise. <p>My enemies want to silence me now for once and for all. This is understandable, because I have hurt them a lot over the years, and I’m going to hurt them even more in the years to come. They have threatened me and sued me many times and are now even trying to use the police to stop me. I can only wonder what they’ll come up with next. Maybe an interdict that prohibits me from teaching people the Treoc Way?</p>
<p>Up until now I’ve been able to fend off every attack, and I will keep on fighting to make people financially free from the greedy, unscrupulous Money Powers and their cronies who feed off ordinary people. They probably won’t stop trying to keep me quiet either. And just imagine if they get it right?</p>

<p><strong>People who regularly work ON their businesses are far more successful than people who work IN their businesses.</strong></p>
<p>Another tough year is over. Of course, it wasn’t a tough year for everyone. The “vultures” and other “scavengers” had a good year, and there may even be another year of prosperity ahead of them, because the recession isn’t over yet. I’m talking about the liquidators and auctioneers now, of course. Most of us, the “prey”, didn’t do quite so well, though. Our money is worth less, the value of our property is not increasing, and our businesses have shrunk. Some of us have already fallen prey to the scavengers and others will still do so. Sometimes when poverty walks in at the front door, love walks out the back, and so many relationships have also gone to the dogs once the scavengers have finished.</p>
<p>It’s always so great to hear stories of “hyenas” who come off second-best, and today I have a story like this for you; but before you scroll down to read the story of <strong>Pinky Sempe</strong>, I just want to remind you of an age-old truth again. And that is the incredible power of the subconscious mind. During the year while we’re fighting full-time to keep the predators away and to grow our investments and businesses despite the recession, we don’t have time to fully make use of our mind power. That’s simply what happens when you have your nose in your business the whole time. The holiday season forces us to take our noses out of the business for a week or two, though, and this is a rare chance that we must not allow to pass us by.</p>
<p>During relaxed times, like during the holidays, one gains a new perspective on problems and opportunities, and along with this, solutions for problems that looked unresolvable just a week or two before. Everyone can attest to this! The solutions that we discover in times like these sometimes astound us because we can’t believe that we didn’t think of them sooner. They are so simple, after all!</p>
<p>Is this not proof enough that you lose perspective if you have your nose IN your business all day and every day? I think so. Don’t you think that we should perhaps proactively arrange more relaxing times? Times for reading, pondering, meditating, and even praying. Can we not work times like these into our busy programmes every day? If we could, our problems would disappear like mist in the morning sun!</p>
<p>Our offices open again on 5 January 2012, and I’m going to use the down-time to work ON my family relationships, friendships, investment plans and businesses.</p>
<p>Below is the incredible story of one of our members in Bloemfontein. Pinky Sempe’s Treoc Trust gave the “scavengers” a bloody nose! 1.   BRIEF BACKGROUND</p>
<p>In March 2007, I was contacted by a member of the committee that was encouraging all the plot owners to sell their properties to the bank and developer. During the initial several contact sessions I refused but later agreed to sell so that the planned township establishment project for affordable housing can be developed in Estoire.</p>

<p>In this instant-gratification world in which we live, it’s seldom necessary to wait. If you want to speak to someone you can phone them immediately. If you want to buy food quickly you use the drive-thru. If you’re looking for information you Google it. And so I could go on and on.</p>
<p>I also like to have things done immediately, but I’ve learnt over the years that it’s not always possible. Some things are simply out of your control, and no matter what you do you can’t make them happen. For instance, you can’t make time go any faster. You can’t even make that happen with prayer. Rather pray that you make peace with the fact that you have to wait.</p>
<p>You may now be asking why I’m writing about this at all.</p>
<p>Making money in any market is a waiting game. Speculators will tell you that it’s a timing game. The fact is that if your timing is out, as is the case with most speculators, and you paid too much because you sold too soon or too late, there is just one thing that can make up for it, and that is time. For instance, if you paid 10% too much for an average house in 2006, according to ABSA’s statistics you would have paid R963,735. The market would have already compensated you for that “mistake”, because the same house would have been worth R1,020,142 in 2010. </p>
<p>If you made a huge mistake in 2000 and paid 50% too much for a house, in 2004 it would have already been worth more than you paid for it.</p>
<p><strong>Property is very forgiving, but you need time and you can’t panic!</strong></p>
<p>With the severe recession that we’re currently experiencing, our patience and ability to wait are being tested to the utmost. It feels as if there is no end in sight. The economists reckon we will only be out of the recession by the end of 2012!</p>
<p>So is it worthwhile to wait then? If you want to create wealth, you have no other choice. If we look at history, we see that the property recession in 1984, ‘85 and ‘86 was much worse than the current one, because it was three consecutive years of negative capital growth. After that the market recovered, and in 1987 property values were higher than ever. But people who got panicky and sold never recovered their losses. By selling in a downward market you make your loss permanent.</p>
<p>We are again caught in a difficult time, just like in the mid-eighties, and we can do nothing about it except wait. Capital growth is not something that anyone can speed up. You have to buy and wait!</p>
<p>The current market offers excellent opportunities for buying and waiting!</p>
<p><strong>How is it possible in the current market to get bonds without applying or qualifying for them?</strong></p>

<p>The shortfalls on these properties were all calculated as the worst-case scenario, after making provision for vacancy and maintenance. The values are derived by the recognised Lightstone comparative method, based on information from the Deeds Office.</p>
<p>I know the returns on investment (and they are not typos!) will once again make the non-Treoc Financial Advisors choke on their coffee, but that’s what they are, and they are based on conservative assumptions, as members will see on every property’s “Settings” page in the software.</p>

<p><strong>We learn from case studies </strong></p>
<p>One of the cases we learnt a lot from was the infamous Insolvent Estate C790/2008 of the Surf Trust in liquidation, with the Best Trust Company Western Cape (Pty) Ltd as its independent trustee and Jose Delgado its nominee.</p>
<p>It is the duty of a trustee to act with care, diligence and skill. Prof. Walter Geach wrote in his book, Trusts, Law and Practice, the following; <em>“Reckless behaviour by a trustee would clearly fall foul of this provision, but so would negligence, sloppiness, and general tardiness in carrying out any act on behalf of the trust. A trustee can, it seems fall foul of this duty either by an act or by an omission, and a trustee who merely leaves trust matters in the hands of others, with no further query or interest, would most certainly be in breach of this duty.”</em></p>
<p>One of the duties of an independent trustee is to account for his actions, or lack thereof, when he is requested to do so by the legal authorities. When a liquidation commission asks him to appear before them, he has no choice. He has to give full co-operation immediately, because it’s in the best interests of the trust for him to co-operate fully. If he does not co-operate, it can lead to unnecessary annoyance and even antagonism on the part of the commissioner, the creditors, and especially the creditors’ legal team.</p>
<p>In my opinion, the behaviour of Jose Delgado during the run-up to the formal liquidation hearing of the Surf Trust in 2008 certainly didn’t advance the trust’s case at all. This is what happened; you can judge for yourself whether Delgado had the best interests of the trust at heart in his actions:</p>

<p>Frontier Insurance Consultants (Pty) Ltd and Treoc have decided to become partners. </p>
<p>Frontier is a well-established FSB- and FIA-accredited insurance brokerage that specialises in investments and risk management. In particular, they specialise in short-term insurance and this is the first time that Treoc has officially entered into a partnership with a specialist short-term insurance broker.</p>
<p>This new partnership therefore gives Treoc members access, for the first time ever, to short-term insurance products that are provided by Treoc members who know how the Treoc Way works. </p>
<p><strong>Trusts and Insurance</strong></p>
<p>Something that people often neglect to do is to insure the moveable assets in their trusts against risks such as accident, fire, storm and theft. These would be assets like household contents, jewellery, vehicles, and so on. Something that people may not know is that the “insured” on your short-term policy must be changed as soon as you transfer assets to a trust or when you purchase assets in a new trust. 			<content:encoded><![CDATA[<p>We are still stuck in the worst recession in living memory, and it’s tough these days to track down good news – petrol is at its highest price ever, Malema is still doing his best to chase away investors, the banks are sitting with thousands of houses that they foolishly repossessed from poor people in distress and this has caused the current conditions in the property market. Of course it’s not the worst that has ever happened in the property market. The early eighties were much worse, but it’s still not pleasant to be stuck in these circumstances.</p>
<p>If we look back at the eighties when house prices dropped for three consecutive years, we can clearly see that the best approach at that time would have been to sell nothing, but to buy a few more houses at the lower price instead. The times we’re in now once again require the same discipline and offer the same opportunities.</p>

This kind of negligence was one of the reasons why I personally asked Treoc Limited’s Board in 2008 to cut all ties with the Best Trust Company.”</em>  </p>
<p>Apparently, from mails I receive from members, the Best guys are denying their role in the downfall of the Surf trust and they play the blame shifting game. It was expected and I am not surprised. I am preparing to publish the full verbatim transcription of the liquidation hearing and then everybody will see what advocate Olivier grilled Delgado about.</p>

<p>An economics professor at an American college made a statement that he had never failed a single student before, but had recently failed an entire class. That class had insisted that Obama&#8217;s socialism worked and that no one would be poor and no one would be rich, a great equalizer. </p>
<p>The professor then said, &#8220;OK, we will have an experiment in this class on Obama&#8217;s plan&#8221;.. All grades will be averaged and everyone will receive the same grade so no one will fail and no one will receive an A&#8230;. (substituting grades for dollars &#8211; something closer to home and more readily understood by all).</p>

<p>Rumours are doing the rounds that FNB and Nedbank don’t want to provide bonds to trusts anymore. See some of the reader comments on my article “Not worth the paper it is written on” (27 October on www.lightminded.com).  You will see that some members are struggling, while other members are still getting even 100% bonds for their trusts. I assume that those who are struggling have the wrong advisors, while those who are successful have the right advisors.</p>
<p>Following the comments by our readers, I asked Treoc’s trust advisors to investigate the rumours and give me a legal opinion, and, if the rumours turned out to be true, to suggest a possible solution. They carried out their investigation thoroughly and provided me with a full finding, legal opinion, options and solutions – solutions that they have already been successfully sharing with their clients for a long time…</p>
<p>I’d initially planned to publish their opinion, as usual, under the “Opinions” link on treoc.com, for all members to see, but after studying their findings and recommendations thoroughly, and following on from recent media reports and misunderstandings about the Surf Trust liquidation, I decided that it needed to be handled differently this time. I am convinced that if you follow our trust advisors’ advice properly there will be no reason for any bank to discriminate against your trust for any reason whatsoever. To be able to get to this point, you should operate directly under our trust advisors’ fiduciary supervision, of course. Our trust advisors are all legal graduates with extensive experience in the Trust Property Control Act; they are also members of FISA (Fiduciary Institute of South Africa) and have been elected by them as senior trust administrators as well as senior will drafters and estate and financial planning practitioners. I still believe personally that the main reason why the infamous Surf Trust was liquidated back then was because the Best Trust Company did not properly fulfil their duties as independent trustees. This kind of negligence was one of the reasons why I personally asked Treoc Limited’s Board in 2008 to cut all ties with the Best Trust Company. </p>
<p>Since then we have never again had an incident like the Surf Trust with any of our independent trustees, and I’d like to keep it that way. So if you want to handle your trust business correctly, make contact with my advisors… today still!</p>

<em>My name is Pierre van Wyk.  Together with Pieter Louw we founded the P3 Investment Group in 2003 in Kempton Park. By the way, did you know that “P3” stands for “Pierre, Pieter and Property”?</p>
<p>The time we started teaching our methodology it was more or less the same time Coert started with his presentations in Kempton Park. He invited me to his seminar those days, but I never accepted the invitation. I suppose I will regret it for the rest of my life.</p>
<p>My wealth creation methods worked well and I made a lot of money at a very young age. Why would I go to Coert Coetzee’s seminar? I thought my wealth was invincible like a lot of money always makes you think, but I lost about R30million, during the last recession. I couldn’t except that the Global Financial Crisis (GFC) was the sole reason of my problems and consulted with numerous experts and property advisors including international experts and over the years have met Robert Kiyosaki and Dolf de Roos and everyone confirmed that it was the recession that caused the losses and that there is not much we can do about it. </p>
<p>I didn’t want to accept this, as it meant if in future a similar event would take place, I would have to go through the same pains.  I believed there had to be a better way.  Then I contacted Coert and in spite of the old rivalry between us, he immediately agreed to meet with me. After an hour with Coert explaining to me the Treoc Way in a nutshell, I had that “AHA!!” moment “several times” and Coert confirmed exactly what I knew had to be possible.  In short it was the flaws in the methodology I used that caused so much heartache and I’m excited about the answers I found.  My losses could have been prevented so easily if only I were on the Treoc Way. If I accepted Coert’s invitation in 2003, I still would have had all my properties today.</p>
<p>Making money is easy and I will recover my losses, but protecting and holding money is something different.  Over the years I shared and taught thousands of people how to create wealth using these same methods, but couldn’t show them what I only discovered and experienced now.  I want to call on all those clients to get onto the Treoc Way immediately. <p>Last week Monday in Cape Town, during a top class Business Breakfast where I sat on a panel of experts with Rael Levitt, Samuel Seeff, Marlon Shevelew and Dr Erwin Rode, the well known Property Economist, I had the audacity to indirectly calling one of Dr. Rode’s statements stupid. That was after he again made his long standing statement that it is a better investment to rent rather than to buy a house.</p>
<p>It was a shocker to call such an esteemed man’s statement stupid, but I did immediately asked him not to take it personal. It is business after all! Personally I know nothing about him and he might as well be the sweetest old man walking this Earth.</p>
<p>I obviously also and as always called the Money Powers by name at the function and how they themselves admitted several times that 96% of all people using their pension products will not be able to look after themselves financially one day when they retired. I said that is like admitting to fraud in public without ever getting arrested because they are still taking in new money for these useless products. Somebody should stop them!</p>
<p>However, the money powers did not take it lightly. They will never forgive me for insulting them and their allies from a public forum. I am doing it already for many years. I even did it in their own newspapers as a paid journalist of Rapport for many years before they terminated my services years ago. I don’t think they had an idea those days how detrimental the Treoc Way would eventually be for the pension fund products of their bosses, their shareholders. Over the years the Fraud Peddlers or Money Powers used some of their journalists like their pension fund champion, Bruce Cameron, to bad mouth me wherever and whenever he can.</p>
<p>Bruce Cameron, the award winning “best investigative journalist in South Africa” of 2007, never ever did an interview with me, our directors or managers ever.  When I offered him those days a free copy of my first book, he wrote back to me; “Don&#8217;t bother.we will not review it” (sic). He claims to get his information from the Treoc website, which is a closed and strictly copyright protected website and unless you are a Platinum Member you cannot enter it. Mr. Cameron is definitely NOT a member of our club and since he never talks to us, everything he writes and says about Treoc is therefore purely what his bosses feed him and mostly it is pure thumb suck.  I did however, years ago in February 2007; give him a free lesson on the &#8220;plagiarism&#8221; and &#8220;copyright legislation” of the country. Instead of thanking me and asking me for more free lessons, he never forgave me for setting him straight! In my eyes he is a joke and a hoax, but there are many bullies like him out there, so I suppose he has a good following.</p>
<p>Daars’ hy ou Grootman, nou kan jy weer lekker gaan galbraak oor my en my “ego trips”!</p>
<p>No matter what the media write or say about me &#8230;or not, old “Mr Fearless” is going to go for their bosses, oops I mean their Money Power shareholders, with their fraudulent pension plans and endowment policies.</p>
<p>Oh yes, before I forget; thanks for the free publicity guys. Much obliged!</p>
<p>Anyway, last week, after I “misbehaved” again at the Big Shot Breakfast in Claremont, Cape Town, the Money Powers let their dogs out again like many times before and I am not going into those stories now. I rather want to share with you something I read in the Beeld last week. Although it was not Rode writing it, it is similar to his statements about renting vs. buying. Enjoy!</p>

			<content:encoded><![CDATA[<p><strong>I have said it many times that most Non-Treoc trusts in South Africa are not worth the paper it is written on. </strong></p>
<p>Ryno Venter, MD of Treoc’s partner, <a href="mailto:ryno@treasurytrust.co.za"> Treasury Trust Services</a>, brought the following article under my attention. It is an article about a judgement handed down on 20 July 2011 in the High Court. This case is a must read for all people with trusts and for people knowing people who have trusts. </p>
<p>You will see that if a trust is not properly managed and administered, it is in fact not a trust. Not even if it is properly founded and registered.</p>
<p>One of Treoc’s other partners, <a href="mailto:jozua@topazaccounting.com"> Topaz Trust Accounting</a>, confirmed to me that as at end of September 2011, they administered 3388 trust and that since the founding of Topaz in 2006 only 6 trusts ever were liquidated. This is only 0.18% of the trusts under their management and I think this is the best proof that they know how to administer trusts.</p>
<p>Anyway, read this article below and see for yourself what it is about!</p>
<p><strong>Article by: Creamer Media Reporter on www.polity.org.za</strong></p>
<p><em>The recent judgment of the North Gauteng High Court in First National Bank (“FNB”) v Stefanus Britz (&#8220;Mr Britz”) and 6 others (handed down on 20 July 2011) (“FNB Case”) demonstrate at least two main instances where a trust may be exposed to be not what it is purported to be. These instances are: (i) where, in divorce proceedings, one of the divorcing parties alleges that assets that are purported to be owned by a trust are actually owned by the other party to the divorce proceedings and (ii) where the creditors of a person are looking for assets to attach to satisfy a judgment against such person. The FNB Case, concerns the later instance.</p>
<p>In the FNB Case, FNB provided the Izani Trust (of which Mr Britz and Mrs Britz (Mr Britz’s wife) were the only co-trustees) with an overdraft facility. Mr and Mrs Britz entered into a suretyship agreement with FNB binding themselves as sureties and co-principal debtors with the Izani Trust in respect of the said overdraft facility. The Izani Trust could not service its debt in respect of the overdraft facility until an amount of about R 5 63 363.46, plus interest (“Outstanding Amount”) became due and payable by the Izani Trust to FNB. In the case which was a precursor to the FNB Case, judgment was granted in favour of FNB for repayment of the Outstanding Amounts by the Izani Trust and Mr and Mrs Britz (as sureties). The warrant of execution was subsequently issued against Mr and Mrs Britz in their personal capacities and in their capacities as trustees of the Izani Trust.</p>
<p>When the Sheriff went to the house where Mr and Mrs Britz resided to execute the judgment, he could not find sufficient disposable assets to satisfy the warrant of execution.</p>
<p>The seemingly tangled web of trusts started to unravel. Mr Britz and Mrs Britz said that they had donated the house furniture and all of their movable assets to the 14 Ackermannstraat Trust (of which Mr and Mrs Britz were the only trustees). Therefore, the Sheriff could not attach the movable assets because they belonged to the 14 Ackermannstraat Trust and not Mr Britz and Mrs Britz in their personal capacities.</p>
<p>It appeared from the trust deed of the 14 Ackermannstraat Trust, among other things, that (i) the Brizelle Trust was the sole beneficiary of the 14 Ackermannstraat Trust, (ii) the Brizelle Trust had power to remove and replace any trustee of the 14 Ackermannstraat Trust and (iii) the 14 Ackermannstraat Trust will exist until it is terminated by the trustees (Mr and Mrs Britz).</p>
<p>It further transpired that (i) the house where Mr and Mrs Britz resided was registered in the name of the Brizelle Trust (the occupation of the trust property by Mr and Mrs Britz family was expressly allowed in terms of the trust deed of the Brizelle Trust), (ii) Mr and Mrs Britz were the only trustees of the Brizelle Trust,  .........................<br><br>To read further, please <a href='http://www.lightminded.com/wp-login.php'>log in</a>. <p>If you are a Financial Advisor, Accountant or Estate Agent, this mail can change your life!</p>
<p>We have hundreds of business owners in our club, and as a matter of course in our business we have regular contact with them at club functions and the Treoc Wealth Management Course. I am sure most of you felt the effects of the recession in the turnover and profits of your businesses. Many businesses are smaller today than they were before the recession, but many other businesses don’t even exist anymore.</p>
<p>Long before I started with Treoc I was a senior risk manager for a large short-term insurer. I picked up a lot of experience there, and the Treoc Way as we know it today is largely modelled on that experience. I did risk management for hundreds of businesses and I know what works and what doesn’t, but my old business principles were once again tested by this latest, most severe recession in living memory, and following this I know even better what works and what doesn’t.</p>
<p>I once again saw that the best business principle is cross-pollination. Businesses that look after each other do better than businesses that try to continue on their own. </p>
<p>Another word for cross-pollination in the business context is CROSS-REFERRAL.</p>
<p><strong>Cross-referral</strong></p>
<p>This is a very old principle, practised in particular by the medical and legal professions. For example, your family doctor will refer you to a specialist. A specialist usually has a whole lot of GPs with whom he maintains good relationships, and so he is never without patients. Attorneys, on the other hand, refer their clients to advocates on the same principle. But my problem with this system is that it is only good for the specialists and the advocates, and not actually for the doctors and attorneys, because it is one-way referral that is taking place.</p>
<p>A much better result is achieved by the Treoc Partners, where, for example, the financial planner, trust advisor, short term insurance broker, trust accountant and estate agent refer their clients to each other. It’s a win-win situation. I think this principle of cross-referral is the main reason that the Treoc Partners still exist – and have even grown through the most severe recession ever. The recession hit the property industry particularly hard, with many conveyancing attorneys, electricians, plumbers, letting agents and thousands of estate agents having closed down, but at Treoc we are still in business &#8230; thanks to our partners supporting each other!</p>

			<content:encoded><![CDATA[<p><strong>The court gives permission for an individual’s personal creditors to take his trust’s assets</strong></p>
<p>In <em>Niewoudt and another NNO v Vrystaat Mielies (Edms)Bpk 2004(3)SA486(SCA)</em> the court stressed the importance that all decisions of substance regarding a trust should be reached unanimously by the trustees as trustees are technically jointly in control of trust assets.</p>
<p>In <em>Badenhorst v Badenhorst 2006(2)SA255(SCA)</em> the court granted a redistribution order in terms of sec7(3) of the Divorce Act 70 of 1979 applicable to assets held within a trust created during a marriage as the court found that the trustee was acting in his capacity as trustee, as such, to his own interest as if the trust was part of his own estate. Thus the trust assets were also dealt with as if they were part of his estate.</p>
<p>In <em>Land and Agricultural Bank of South Africa v Parker 2005(2)SA77(SCA)</em>  the court found any transaction entered into by a sub-minimum amount of trustees as described in the trust deed to be unlawful. Thus, where trustees were not authorized to act without the consent of all the trustees, the transaction would not be allowable that was entered into.</p>
<p>One of the reasons that we use trusts is so that personal creditors cannot seize trust assets. But it is shocking how few trusts in South Africa offer this protection. To be honest, most trusts DON’T offer this basic protection. Not even trusts that are managed by some so-called “professional independent trustees” offer this protection. </p>
<p>Take responsibility today and protect your trust’s assets. If you don’t do it, you are neglecting your duty as trustee as stipulated in the Trust Property Control Act 57 of 1988. It could even be seen as a criminal offence. </p>
<p>It is thus very important as trustees to make sure the administration of the trust is done correctly and is up to date – remember ignorance is not an excuse in the eyes of the law!</p>
<p>Your trust should have a general resolution where some of the trustees, like yourself or you and your spouse for example, are authorized to utilize the trust fund to a certain extent – this resolution is a “blanket” for day to day purchases in the trust.</p>
<p>The reason why most trusts don’t offer this protection is because of the way in which trust assets are purchased. If, for example, I go to a dealer and buy a lounge suite with the trust’s money, that lounge suite will only be considered a trust asset if I have followed the correct procedure. This is a once-off procedure; the resolution is determined at a meeting of all the trustees, and must be signed by all the trustees. I know this sounds like a lot of fuss, but it isn’t. It is a blanket resolution that only has to be done once – but then it must be done correctly. The philosophy behind performance-based remuneration or paying for performance is to reduce any job function in the business to measurable units so that you can then pay a pre-determined fee for that unit of work to be done.</p>
<p>Think about it like this:<br />
<em>If someone is paid for the time they work versus being paid for the results of that work, they are incentivised to do as little as possible per hour as they know that they need to stretch the work load to fill up the hours in the day. If however they are paid for the completion of a task at a certain quality standard, then they are incentivised to do as good a job as possible in the shortest possible time.</em></p>
<p><strong>What is Performance-based Remuneration?<br />
</strong><br />
Performance-based pay links remuneration to individual achievement (or non-achievement) of predetermined outcomes and/or the performance of the company. It takes several forms, including performance-based changes to base remuneration and the provision of bonuses and other one-off type rewards.</p>
<p>Remuneration is the monetary value of the compensation an employee receives in return for the performance of their contracted duties and responsibilities. </p>
<p><strong>How is Performance-based Pay Measured?</strong></p>
<p>Performance-based pay is aligned to outputs and achievement of predetermined outcomes. From a performance point of view the key measurement indicators include:</p>
<p>1.	Achievement of goals such as Financial and Physical objectives<br />
2.	Effectiveness &#8211; Doing the right things<br />
3.	Efficiency &#8211; Doing things right<br />
4.	Improved productivity &#8211; Doing more with less<br />
5.	Innovation &#8211; Doing new things or performing the same tasks but differently </p>

Someone sent me the following little story:</p>
<p>The town is under water due to flooding, and the priest is standing in the street and praying for the town.</p>
<p>When the water reaches his knees, a boat stops and invites him to climb in. “No, you go on; I’ll wait here, because the Lord will take care of me,” says the priest.</p>
<p>When the water reaches his hips, another boat stops next to him, and again he says no, because the Lord will take care of him.</p>
<p>When the water reaches his neck, a third boats stops next to him, and again he says no thank you, the Lord will take care of him.</p>
<p>And so he drowns…</p>
<p>When he gets to heaven he asks the Lord: “Why did you let me drown? I dedicated my whole life to working for you. I always carefully obeyed all your commandments, but still you let me drown.”</p>
<p>The Lord then said to him: “Good grief, you ungrateful man! What nonsense are you speaking? I sent you three boats!”</p>
<p>I think most people don’t see the “boats” or opportunities that God sends them, and then when they one day find themselves battling financially or when they lose everything, they can’t understand why God is punishing them like this.</p>

			<content:encoded><![CDATA[<p>After my recent Lightminded article “A Good Loser? &#8211; Nonsense, winning is everything!” I received a lot of comments. Mostly from people agreeing, but also a few nasty ones from people with bruised toes. Hopefully this article will give you all a better perspective of the winning game. It is actually a Treoc Times article for Platinum members only, but I have decided to share it with all my readers this time because I want you all to be WINNERS!</p>
<p>According to the recently released World Economic Forum&#8217;s Global Competitiveness Report 2011-2012, South Africa has improved its global ranking by four places to attain 50th position this year. We remain the highest-ranked country in sub-Saharan Africa and the second-placed among the BRICS [Brazil, Russia, India, China, South Africa] economies. Of course, there is always room for improvement. But this is the beauty of competitiveness – it creates room for improvement – not only for our country, but for our businesses, for us as individuals, and for our competitors. </p>
<p>In light of this, let’s consider what exactly it means to be competitive. Being “competitive” is often regarded as a negative trait. But in reality being “competitive” is absolutely crucial to achieving success, continuous improvement and ongoing innovation and progress.</p>
<p>An example will illustrate. If two boxers step into the ring and neither is particularly competitive – in other words, neither is particularly interested in winning &#8211; it will be a disappointing fight indeed. They will simply prance around the ring, throwing half-hearted punches and, in the end, no-one wins, especially the spectators. </p>
<p>If only one of the boxers is interested in winning, it will also be a disappointing fight, since the winner will not win by merit, but simply by default – and every person who has ever experienced the ecstasy of winning fair and square against a worthy opponent will know that there is no glory and no pleasure in winning by default. </p>

			<content:encoded><![CDATA[<p><strong>Nonsense, winning is everything!</strong></p>
<p>Two of my children went to a primary school where they were taught how to be good losers. Can you believe it? I was livid when I heard about it, but let me tell you the whole story.</p>
<p>They were both very good at sport, especially rugby, but unfortunately the school had a teacher who seemed unable to coach the team well, because they lost many of their matches. I and some of the other fathers often spoke about it on the side of the field. We couldn’t understand why the team struggled so much, because there was nothing wrong with the players’ abilities, yet they just couldn’t win!</p>
<p>But one day I found the answer in an innocent remark that the children made to me after one of these matches that they lost. As we once again lamented the loss and I tried to encourage them, they told me that the teacher had said to them: “Winning isn’t everything, and you don’t have to feel bad at all, because I don’t think you are bad losers. Just as long as you enjoy it!” This made a lasting impression on me, and it made me decide to teach my children that losing is not at all acceptable. If you are not a bad loser, it means you are a good loser. As far as I’m concerned, a bad loser or good loser is still a loser.</p>
<p>All the games that my children and I play – like chess, Monopoly, cards, pool, and so on – are real competitions. I never let them win just because they were young, and I always made a big issue of the fact that I was the best. I didn’t always win, though; and believe me, on those occasions that they beat me, they made an even bigger issue of it. Today it’s still their greatest achievement to beat me, for example, at the pool table. And nowadays it happens pretty often, because they are good!</p>
<p>My children are competitors, and they are winners. If the competitive environment in which they were raised had something to do with that, then I’m grateful, but one thing is certain: I never made them feel good if they lost. I did teach them to control their emotions and to not show how bad they feel when they lose. I taught them to never give up, and that even if you lose a battle sometimes, it doesn’t mean you’ve lost the war. If they’ve lost, you can be sure that they will come back and they will try again and again until they win, because we’re bad losers. </p>
<p>Show me a good loser and I’ll show you a loser, plain and simple!</p>

<p>Maybe I am going to step on a toe or two now, but I’ve been watching the people who plead poverty for years already, and I can assure you that not one of them has ever been able to break that poverty stranglehold.</p>
<p>Over the years I’ve met people who always want to get a discount on everything.<br />
Some of them will tell stories of how much they’re struggling, and say that they can’t afford the membership fee, for instance, or the seminar fee. Others just want to get discount because it’s a part of their lifestyle. For them it’s a matter of principle to always negotiate a discount on everything. Do you know people like this? Think about it. I’m sure you know people like this. Perhaps you’re one of them yourself! </p>
<p>Nonetheless, if you know people like this, you will know that they’re not very successful financially. All poverty-pleaders and discount junkies are average, and they will stay average forever, because they lead discounted lives.</p>
<p>If your mind gets used to half-price, it also gets used to doing everything in half-measures, and then eventually you find you’re living a half-measure life. I don’t know of a single half-price person who is achieving their income potential at full price.</p>
<p>The saying goes: <em>What goes around comes around.</em> Very true!</p>

<p>There are some financial secrets that you’ll never be taught at school or university, and it’s normally these very things that make the difference between being rich and poor. This is because we live in a society where money and wealth is regarded as bad and evil by the masses. To teach people to become rich is thus not “proper”.</p>
<p>The “old money” secrets of the exclusive elite never get shared with the masses, because the elite feed on the ignorance of these masses. They do, however, teach their children how to do it. </p>
<p>The working masses don’t know the secrets; rather, they believe that you should be taught to be hard-working, and scholarly. If in the process you attain financial success, that’s great, but don’t boast about it. This is how we’ve been programmed for centuries; it’s also why the few normal people that do see the light never share their money-making secrets with others. </p>
<p>At Treoc.com we feel differently, and we share our money-making secrets with each other. Firstly, before I go to the topic of the day, just a bit of feedback on my mail of last week. The response was fantastic! So far I received 1119 mandates to the value of R517,530,606. <p>Back to the topic of the day. </p>
<p>I’ve been reading that the respected property economist, the bearded Doctor “DON’T-BUY-RATHER-RENT”, is once again seeing only doom and gloom in the residential market. This isn’t news, of course, because that’s how he’s always seen it. The bearded doctor maintains that real property growth is lower than inflation, so you’d be better off investing your money in other commodities. He doesn’t take into account that we can gear property. Let me give the doctor a simple example again, because one day someone is probably going to forward this to him, and I don’t want him to struggle to understand it. </p>
<p>Let’s take an investment of R250,000, on a Treoc-type townhouse of R500,000, with a bond for the balance. If the capital value grows by just 5% per annum, the return on investment in the first year will be 10%. But this type of property doesn’t grow at a mere 5% per annum. According to ABSA’s annual property statistics, properties like this, 80m2 – 140m2 have been growing as follows:</p>
<p>Average for the last 5 years is 6.3% per annum<br />
Average for the last 10 years is 13.8% per annum<br />
Average for the last 20 years is 11.5% per annum<br />
Average for the last 40 years is 11.4% per annum</p>
<p>So if someone had invested his money for 40 years in Treoc-type properties, with only 50% bonds, his return would have been on average 23% per annum. If he used 90% bonds, the return would have been approximately 60% per annum.</p>
<p>By the way, every time I publish calculations like this, I get a lot of criticism from the financial advisor industry. They say my calculations are incorrect. Guys we work with many variables and therefore it is understandable that my calculations might differ slightly from yours, but the bigger picture is 100% correct.</p>
<p>I’m sure the learned doctor can do these calculations himself. So why doesn’t he, then? I wouldn’t be surprised if the money powers pay him to put forward this rubbish. After all, the money powers want people to believe this nonsense and rather invest their money in useless annuity products and savings plans.</p>
<p>As I said, his story isn’t going to change, and in the past he has already attacked me personally from the podium because I tell people that property is an outstanding investment. But what is different with his latest nonsense is that he apparently can’t understand why South Africans are so obsessed with property ownership, and he recommends that they rather follow the European practice where 60% of people rent and never buy property. To hold this up as the ideal is the most ridiculous remark, advice, or whatever else you want to call this sort of nonsense, that I’ve ever heard.</p>
<p>In my first book, Let There be Light on Wealth Creation, one of our Treoc members, Bettina Horvath, told her story. I’ve published the relevant excerpt below. If you read it, you will see why 40% of Europe’s people are getting richer while 60% of them are getting poorer. Is that what the doctor and the money powers want? Someone should stop them!</p>

<p><strong>Back to the topic of the day </strong></p>
<p>As you know, financing property in South Africa is very frustrating. These days it’s easier for me to get financing in Australia than in South Africa, which is concerning. Property is only the best investment in the world when it’s geared with financing.</p>
<p>Did you know that our bonds actually cost the banks nothing? It’s standard practice for banks to sell our bonds’ documentation – or let’s call it the “promise to pay” – to big international financing houses. They call it securitisation in the financing world.</p>
<p>I don’t want to go into the details of securitisation now, but this made me wonder – why can’t we sell our own bonds to these big financing houses? The reason we can’t is because these big financing houses don’t play with pocket change. If they can’t get at least 1,000 bonds in a single transaction, then they’re not interested. The more bonds you offer them, though, the more interested they are, and most importantly, the more bargaining power you have.</p>
<p>In the last while I’ve had many discussions with people who are experts in mortgage products, and according to them it shouldn’t be too difficult to get our own Treoc Type Mortgages if we have the volumes.</p>

<p>A very serious warning to all of those who are not serious about their trusts! You are sitting on a time bomb.</p>
<p>I read that the Internal Revenue Service (IRS) in the USA has started cracking down on trusts that they have judged to be illegal. This is definitely going to happen in South Africa too. </p>
<p>Apparently, 6 % of the three million active trusts in the U.S. today are considered &#8220;highly suspicious.&#8221; I think the number is much higher in South Africa, because we have independent trustees calling themselves the “best” while, for example, they never have annual meetings with their fellow trustees. If they are not even doing these basics right, how are they doing the serious things like the trust deed and resolutions? To name just two aspects of the many.</p>
<p>Over the last few years I’ve warned the South African public a number of times about the “Riches to Rags” time-bombs they’re sitting on. Most of the time I’ve done it subtly, but sometimes I’ve dispensed with all the supposed marketing ethics and mentioned the time-bomb builders and distributors by name.  </p>
<p><strong>Nobody calls a spade by its name anymore!</strong></p>
<p>Every time that I’ve broken the “code” and mentioned them by name and warned people against their malpractices, I’ve received a flood of threats, objections and insults because I was breaking the “code of ethics”. Some of them have already tried to scare me with summonses for defamation, and others again have set their liquidators or journalist friends upon me. All their attempts thus far to do damage to or to silence me or Treoc have been unsuccessful, though, and the reason they’ve been unsuccessful is the infallibility of the Treoc Way.</p>
<p>Let me give you a bit of background about how some of these time-bombs get built.</p>

<p>Be careful of discussing company matters informally with fellow directors, managers or staff. Rather do it only at official directors’ meetings.</p>
<p>It is exceptionally important for directors to ensure that the following items are properly minuted during their meetings:</p>
<p>- all documentation and information that is laid on the table<br />
- any advice that is received and considered<br />
- on what grounds decisions are taken in the best interests of all stakeholders</p>
<p>If a director does not agree with a decision, he must ensure that his opinion is minuted, and that it is noted that he voted against the decision.</p>
<p><strong>Technical insanities are tough realities</strong></p>
<p>Don’t laugh them off.</p>
<p>The infamous section 424 of the Companies Act implies the following ridiculous, but dangerous contradictions:</p>
<p><strong>Paradox 1</strong></p>
<p>If you are the trustee of a trust that owns shares in a company, and if you stay abreast of the company’s activities, you can be held responsible by creditors if the company is one day liquidated due to a recession.</p>

<p>Since 2003 27,000 have attended my seminars, and only a few joined the Platinum club or have the will to make money. </p>
<p>Platinum members are getting richer and the rest are getting poorer. Why is it like this?</p>
<p>I think it has something to do with the way we were raised. See if you recognise the following phrases:</p>
<p><em>“My child, you must be careful.”<br />
“My child, you should rather not do that.”<br />
“My child, rather get a good job.”<br />
“Rather work for your money, my child.”<br />
“Don’t make debt, my child.”<br />
“You must work harder, my child.”<br />
“You must save, my child.”</em></p>
<p>In essence, there’s nothing wrong with this well-intentioned advice given by our parents, but it does depend very much on the circumstances of the parents themselves. Most people’s parents were strugglers, just as their parents were too, and so therefore their children will also be strugglers. If you take advice from strugglers, you will eventually struggle yourself as well. </p>
<p><strong>Rather ignore your struggling parents’ advice and listen to Uncle Bob<br />

<p>People believe the nonsense of a certain bearded economist, that it’s better to rent a house than to buy.</p>
<p>People believe a certain rich estate agent, who only wants to make the luxury market look good.</p>
<p>People believe share pedlars like a certain Kabous, who doesn’t even know that property generates capital and income.</p>
<p>At the Treoc Way Introduction seminars in Sandton and Stellenbosch I shared one of my big “secrets” with the people for the first time ever. For the first time I shared with the members and their guests the spreadsheets showing my statistics and moving averages for the past 45 years. I showed them how to read the bank’s statistics like an investor instead of an economist or journalist. Did you know that very few, if any, economists and journalists are property investors? True story!</p>
<p>I’ve never shown these statistics and techniques at seminars before, because I thought they would be too technical, but the reaction was fantastic. For the first time people can now see, on the basis of the bank’s own figures, how I’m managing to double my investment money every year, in spite of the most severe recession of all time – without effort or special knowledge; just with logical investment methods.</p>

<p>Looks like the whole property rates debacle is just a lot of hot air. The newspapers blew it out of proportion again and did a lot of damage to the property market with the rubbish they wrote.</p>
<p>Apparently the minister clarified it last night on Radio 702. Maybe the ANC is not as stupid as I thought&#8230; in this case anyway.</p>

<p>Since the proposal to amend Section 1 of the Property Rates Act appeared on Lightminded last week and in the Sunday papers yesterday, some property investors are in a state of panic. Today many people are trying to sell their properties because they think they cannot afford the proposed increase.</p>
<p>This is the most stupid thing you can do!</p>
<p>I am not going to sell my properties and thanks to all the ignorant people buggering up the prices with their panic and market flooding, I will buy a few more.</p>
<p>At this stage the intended amendment is just a proposal. Do you get it? It is a PROPOSAL! It is not law yet. If, and it is a big IF, it goes through, it will not be soon. However, if it goes through we will add it to the rent. It is NOT going to cost the property investor anything. The panic of the moment which results in people trying to dump their properties will cause much, much more damage than the proposed amendment.</p>
<p>Unfortunately, or should I rather say fortunately, most so-called property investors are not members of our club and are not educated in long term investment. Therefore we can prepare ourselves for a buyer’s market like never before.</p>
<p>The world’s greatest investor, Warren Buffett, never panics. He said:</p>
<p><em><strong>&#8220;I will tell you how to become rich. Close the doors. Be fearful when others are greedy. 			<content:encoded><![CDATA[<p><strong>URGENT ALERT TO ALL PROPERTY OWNERS AND TENANTS</strong></p>
<p>Our government is always looking for more and more ways to milk the public. As always they cannot see the consequences their actions will have on their voters, the poor people of this country. And the poor people are too stupid to see what their elected government is doing to them. That is why they vote for them time and time again. </p>
<p>The fat rolling masses striked against their own government 30 days before the election. The police even killed some of the strikers in cold blood. Then the masses voted for the same government again. Thirty days later they striked against them again. This is how the stupid fat rolling masses attempt to sort out their problems. </p>
<p>Goeie genade! Kan mense met breinselle so onnosel wees?</p>
<p>The government’s latest milking trick is a new proposed “MUNICIPAL PROPERTY RATES AMENDMENT BILL”. The proposed increase in rates will probably not cost us, the investors, anything. It will just be handed down to the poor tenants again, but I think it is our duty as the only people with brains to try and stop this.</p>
<p>Paul Retief, one of our members, sent me the following correspondence and I suggest we follow his advice.</p>
<p>There is a proposal to amend Section 1 of the Property Rates Act to the effect that all residential property, used to accommodate persons other than the owner for gain, should be charged commercial rates on the property. </p>

<p>This would severely affect the monthly costs of owning property and impact severely on investment buyers; those people who rely on income from their property/ies and ultimately on tenants.</p>

These days every Tom, Dick and Harry is a supposed expert on the Treoc Way; and as long as things are going well they will gladly take the credit for it, but as soon as things go wrong, they blame yours truly. Even when someone loses his job and can therefore no longer afford his shortfalls, I get blamed. The fact that he would have lost his job anyway and that it has nothing to do with the Treoc Way, or the fact that thanks to the Treoc Way he has only lost debt and not assets doesn’t get taken into consideration at all.</p>
<p>Recently an advisor who supposedly knows the Treoc Way recommended that a member buy assets in his personal name because he is ostensibly too old for a trust. That’s nonsense. No-one is ever too old for a trust. The worst part for me is the fact that the member followed this kind of advice! This is NOT the Treoc Way, and I don’t care who you got this advice from. I don’t care what the advisor’s qualifications and accreditations are either, or that the advisor’s advice was meant well. It is NOT the Treoc Way… full stop!</p>

<p>As mentioned in the article “Changes to the Treoc Way” I was recently shocked to learn that there are trustees who have not held a meeting for years on end. That is very foolish and irresponsible! </p>
<p>The Trust Property Control Act doesn’t give specific dates or periods when trustees should meet, but it is specific about the fact that trustees have a big responsibility. Now the question is: how responsible is responsible enough? And that’s where common sense and common law come into play. What would the reasonable man regard as responsible? If a creditor wants to take your trust assets, he has to be able to prove to the court that your trust is not a trust in the true sense of the word. If he can prove that the trustees have not fulfilled the role of trustee, you’ve given him an opportunity to persuade the judge that the trust is a false entity, or “scam” as they call it. And then the trust assets are in danger.</p>
<p>Since the Trust Property Control Act 57 of 1988 consists of just 7 pages with 27 clauses you’re not going to learn much from it. That’s why the interpretation of the law is almost more important than the law itself. But we can’t each go and interpret the law as we see fit. Only the court can and may officially interpret the law. This means that if the creditor can just discredit you in the eyes of the judge, then the chances are good that the judge will take the creditor’s side. So if you don’t hold at least one trustee meeting per year and cannot provide the minutes of these meetings to the court, you are helping the creditor.</p>
<p>The trust expert, Prof Walter Geach, writes in his book “TRUSTS Law and Practice” the following:</p>

The world we’re living in is becoming more and more regulated each year. If you just think about the new laws that have been implemented in the past while, you’ll realise that I’m not exaggerating in any way when I say that it’s hard to stay out of trouble these days. It’s very easy nowadays for a trustee or a director to unwittingly land up in trouble.</p>
<p>Laws that come to mind are the National Credit Act, the Consumer Protection Act, and the new Companies Act. These three acts alone have permanently changed the environment in which we live and do business. The “environment has become dangerous”. And I’m not even talking about court rulings, which are becoming stranger and stranger as a result of ignorant people ending up on the Bench due to political policies. Every ruling is like law once it’s been issued, even if it differs in substance from the law – and there are some strange rulings. For example, how can one party be found guilty of a bribery transaction and get fifteen years in jail, while the other party to the same bribery or “tango” gets off scot-free? How can the person who goes to jail be declared terminally ill two years later and then, as a “dying patient”, play golf regularly after that? This is just one of the well-known cases, but there are many others that you haven’t even heard of.</p>
<p>There is also no such thing as differing liability for executive and non-executive trustees and directors anymore. In the eyes of the court, there is no such thing as ignorance either. “Ignorance is no excuse.” Even shareholders who are not directors or employees of a company have responsibilities and accountabilities. The notorious article 424 of the Companies Act sees to this thoroughly.</p>
